The Firm Helps Newton County Prevail in Upholding Impact Fee Ordinance

Former Chief Justice Fletcher and Partner Andy Davis assisted Edward Tolley of Athens and Newton County Attorney Tommy Craig to successfully uphold the Newton county Impact Fee. The Newton County Homebuilders Association and the Homebuilders Association of Georgia sued Newton County in December 2005, alleging that the Newton County Impact Fee was unconstitutional and procedurally defective. On December 10, 2007, Honorable Horace Johnson held a bench trial and ruled that the County had reasonably related the impact fees to the new growth and development of the capital projects identified in the County's Capital Improvements Element which it adopted on February 1, 2005. The Newton Citizen, a daily newspaper in Covington reported on the case.
