Bob Berry and Lee Carter represented Synovus Financial Corp. (NYSE: SNV), a financial services company with $27 billion in assets based in Columbus, Georgia, in a lawsuit filed in the Superior Court of Walker County concerning an alleged wrongful foreclosure. On behalf of Synovus Financial, Bob and Lee removed the case to the United States District Court for the Northern District of Georgia, Rome Division, and filed a motion to dismiss contending that Synovus Financial had been fraudulently joined as a defendant solely to defeat diversity jurisdiction and that their client should be dismissed from the lawsuit. On March 12, 2012, the District Court agreed with that position, finding that Synovus Financial had no connection to the controversy, that it had been fraudulently joined in an attempt to defeat diversity, and dismissed Synovus Financial as a named defendant.
