On March 27, 2012, the Eleventh Circuit Court of Appeals affirmed the dismissal of federal claims brought against two Georgia Game Wardens, the City of Chatsworth, Georgia, and three City of Chatsworth police officers. Andy Davis and Sam Lucas represented the City of Chatsworth, Georgia and its police officers in the action. In his complaint, the plaintiff asserted claims for alleged violations of his Fourth Amendment rights and malicious prosecution surrounding his arrest for stalking a Game Warden. Davis and Lucas filed motions to dismiss contending that the complaint and the amended complaint failed to state a plausible claim for relief. The District Court, Judge Harold L. Murphy presiding, agreed and granted two motions to dismiss filed by the Firm with the second being affirmed on appeal. The case is styled Henry v. Jones, et al., U.S. District Court for the Northern District of Georgia, Rome Division, No. 4:11-CV-0064-HLM, and the Eleventh Circuit case number is No. 11-14564.
