Brinson Askew Berry attorneys Andy Davis and Sarah Martin successfully defended Clean Water Act claims, along with King & Spalding attorneys Douglas Henderson and Nicholas Howell. The case was tried before a jury in federal court in Atlanta, starting on July 29 with the verdict on August 6.
Davis, Martin, Henderson and Howell defended a developer in a citizen suit alleging violations of the federal Clean Water Act, as well as trespass and nuisance claims. Following a seven-day trial in the Northern District of Georgia, the jury found no violations of the Clean Water Act. The defense team also obtained a favorable outcome for the client on the trespass and nuisance claims.
