Products liability law is premised on the idea that companies who manufacture, sell, and distribute faulty products should be held accountable when someone gets hurt because of their negligence. Products liability law deals with three different types of unsafe products:
- design defects;
- manufacturing defects; and
- warning defects.
It can apply to tools, machinery, toys, contaminated food, flammable clothing or textiles, medical devices, and pharmaceuticals, among other things. Further, products liability can be a strict liability offense, meaning that even if the defendants were not necessarily negligent, the injured person may still be entitled to compensation.
